Terms and Conditions 

These Terms and Conditions (‘Terms’) apply to your access and use (and subscription to) the Revia website https://www.revia.com.au (‘Website’), Revia mobile or digital application (‘App’), and associated fitness and mindset Services provided by Revia. Please read these Terms carefully before using the Service.

These Terms are entered into by and between you as a user (referred to as ‘User’, ‘you’, or ‘your’) and Revie Jane & Co (ABN 97 610 669 353) (referred to as 'Revia', 'we', 'our', or 'us'), and supersede and replace any terms and conditions of services that you may have previously agreed with Revia. 

By accessing any part of the App, you indicate that you accept these Terms. If you do not accept these Terms, you should cease using any part of the App, Website and Service immediately. 


Definition of Terms

App: means the current or any future version of the Revia application with which you access the Program. 

Program: means the fitness and/or mindset program you have selected through the App or Website. 

Service: means the fitness or mindset services provided by Revia through the App, Website or other mediums as may be available from time to time. 


1. About Revia

1.1 Revia offers a variety of digital fitness and mindset programs through the Website and App. The Programs are general in nature and have been designed to support your mental and physical wellness. Revia does not offer face-to-face personal training or individually tailored exercise.

1.2 Revia does not guarantee any specific results from participation in any Program or Service.


2. Terms of Use

2.1 Revia is only available to those individuals 18 years of age or older who have full capacity to enter binding contracts on their own behalf or on behalf of those individuals under 18 years of age for whom they have legal responsibility. You are not permitted to use Revia if you are not 18 years of age or older unless you have the consent of your parent or guardian.  

2.2 By using our App or Website, you: (a) confirm you have read, understood, and agree to these terms; (b) consent to the use of your personal information as outlined herein; (c) agree to receive communications from Revia.

2.3 We reserve the right to revise these Terms from time to time. If we update the Terms, we will provide reasonable advance notice to you by way of email to your email address linked to your account for the App or Website. The new Terms will apply from the expiry of the notice period. You will be subject to the Terms that are current and in force at the time that you use the Service. If the update to the Terms is detrimental to you, you may terminate your account within the notice period, by written notice to hey@revia.com.au.


3. Program Duration

3.1 Upon purchasing a Program via the App, access is granted for the duration specified for that Program.

3.2 Access to the Program will not be paused or extended except under medical circumstances.


4. Licence

4.1 All Programs are licensed to single users only. You are permitted to use the App for your own personal non-commercial use only. The Licence is not transferable.  

4.2 You are not permitted to use, reproduce, disseminate or store any part of the App, without our prior written consent to do so. 


5. Code of Conduct

5.1 Users must not: (a) Share account details; (b) Post defamatory, harassing, or offensive content on Revia forums or social platforms; (c) Misrepresent Revia content or misuse its brand.

5.2 We reserve the right to suspend or terminate your account for breaching these terms.


6. Payments & Refunds

6.1 Purchases must be made through the in-app payment system or external app stores (Apple App Store or Google Play Store).

6.2 All external purchases are subject to the app store provider's terms. Revia is not responsible for refunding or resolving payment disputes made via these platforms.

6.3 Program access will begin from your purchase date or Program start date, whichever is earlier.

6.4 No refunds are provided for change of mind, accidental purchases, or unused Programs unless required by law.

6.5 In cases of medical concerns resulting in an inability to participate (e.g., injury or pregnancy), users may request a credit or deferral by providing appropriate evidence to hey@revia.com.au.  We may elect to offer a credit or deferral, in our discretion.


7. Privacy

7.1 Revia values your privacy and seeks to safeguard your privacy by handling all your Personal Information in accordance with applicable data protection legislation, including Privacy Act 1988 (Cth).

7.2 Personal Information is any information about you that identifies you or which your identity may be reasonably determined. By collecting this Personal Information from you, we are able to contact you when and where necessary, ensure that you attain the best possible service and identify you and protect you from any unauthorised access to your Personal Information. If you choose not to provide Personal Information to us, we may not be able to provide you with access to parts of the Website or the App. 

7.3 By providing us with your Personal Information by using the App or Website, you consent to us collecting, storing, using and disclosing your Personal Information to administer Programs, process payments, communicate updates, and improve services.

7.4 We may store or process data with third-party providers, including those overseas, for operational efficiency.

7.5 If you are accessing the App or Website in the United Kingdom or the European Union, and if the General Data Protection Regulation (GDPR) applies to our handing of your Personal Information, we agree that we will comply with our obligations under all data protection legislation.   


8. Medical Disclaimer

8.1 You acknowledge and agree that participation in any exercise, fitness, or wellness Program made available through the App involves inherent risks, including but not limited to physical injury, illness, or death. By using the App and its associated Services, you voluntarily assume all risks related to such activities.

8.2 Before beginning any Program offered through the App, you are strongly advised to consult with a qualified medical practitioner or healthcare provider. This is especially important if you are pregnant, suspect you may be pregnant, or have any known or suspected medical or physical condition.

8.3 The App and Services are intended for general informational and educational purposes only. We are not licensed medical professionals and do not provide medical advice, diagnosis, or treatment. Nothing contained in the App should be construed as a substitute for professional medical consultation, evaluation, or care.

8.4 While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding the completeness, reliability, or suitability of any content, product, or service offered through the App. You are solely responsible for determining whether any activity or recommendation with a Program is appropriate for your individual circumstances.

8.5 If you experience any discomfort, pain, dizziness, or other unexpected symptoms while using the App or participating in any activity promoted through it, you must immediately discontinue use and seek medical attention.


9. Liability

9.1 To the fullest extent permitted by law, Revia and its employees, agents and partners will not be liable to you, arising under or in connection with the Service or the Application (including the use, inability to use or the results of use of the Service or the Application) for resulting from any violation by you of these Terms or any breach by you of your responsibilities, representations and warranties

9.2 We do not guarantee uninterrupted access or that the App will be free from errors, viruses, or bugs. While we try to ensure the App is available twenty four (24) hours a day, we do not undertake any obligation to do so, and we will not be liable to you if the App is unavailable or otherwise not fully or properly functioning at any time or for any period. 

9.3 You agree to indemnify and hold Revia and its employees, agents and partners, harmless from and against any claims, demands, proceedings, losses and damages arising out of your breach of these Terms and your use of the App or Service.


10. Intellectual Property

10.1 All content, branding, and materials provided by Revia are the intellectual property of Revie Jane & Co and must not be copied, reproduced, or redistributed without prior written consent.


11. Communications

11.1 By creating an account with Us, you agree to receive emails and/or App notifications relating to your membership, Program reminders, product updates, and promotion and accept that communication with us will be mainly electronic.

11.2 For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications we provide to you electronically comply with any legal requirement that such communications be in writing. 

11.3 You may opt out of these promotional messages at any time by following the unsubscribe link, however this may affect the quality of your user experience.


12. Governing Law and Jurisdiction

12.1 These terms are governed by the laws of Queensland, Australia.

12.2 Any disputes or claims arising in connection with these Terms will be subject to the exclusive jurisdiction of the court of Queensland.


13. Severability

If any of these Terms are proved void, unenforceable or illegal in a jurisdiction, that provision, or part of a provision, is deemed omitted without affecting the legality of the remaining provisions which will continue in full force and effect.
